General terms and conditions:
The country villas are located on the west side of the canary island La Palma, in the community area of the village Tijarafe. They are situated at a distance of about 70 – 110 m. from each other (private setting) on a huge estate (22.000sqm) in an appealing Landscape with a beautiful view onto the Atlantic and the mountains.
1. Terms of use:
· The user receives – additionally to the other information about the organization – two copies of a surrender of use and two copies of the associated house rules. He will sign all of them and send both surrender of use copies and one copy of the house rules to the owner. The owner will send back one of the surrender of use copies signed by him. With this, the agreement to the surrender of use is considered accomplished. It obliges both the user and the owner. In case the user certificate differs from the original surrender agreement, the user can withdraw from the offer within 10 days, notifying this in written form.
· In the user fee, which is agreed to in the surrender of use, the extra costs fortowels, bed linen, water, electricity, access to the Internet, are included. A commission of 20% of the total cost is requested immediately, but at the most 1.000 Euro. The rest of the user fee is to be transferred up to 20 days before the beginning of use.
· Other extra costs (for example, the intermediate and final cleaning) will be payed to the administration on site.
· Special requests, additional agreements are only valid if they have been confirmed by the owner in written form.
· The owner provides Internet access – ADSL, from the Telefónica España. There can´t be given a guarantee for the operating of the access. In the case there would be disturbances, the owner will endeavor to contact the responsible Institutions and request a fast repair.
· The requirements of this contract prescribe six months after the contractual time limit, which the user has spent in one of the Vacation Villas. Claims have to be sent immediately to the house administration or to the owner. The announcement of requirements after the time of use shall be deemed to be effect less. – The houses can only be occupied regularly by as many people as has been agreed to in the surrender of use. The stated number includes children and babies. It is not allowed to bring pets.
· The country villas are arranged in a high standard; in the optimally equipped kitchens you will find electro - cooking- and baking ovens, microwaves, coffee machines, kettles, dish washers, toasters, fume cupboards, refrigerators and freezers. Every room is heat able. In the living room are, as well as seating- accommodation, small libraries, landline Telephones, Internet accesses, hi- fi systems (with CD), Satellite- TVs and stoves, firewood is available.
· All the houses are situated on a joint, huge, cultivated subtropical garden with walking paths. The garden furniture on the Terraces of the country villas (garden chairs, garden tables, parasols and sun beds) can be used. It is naturally understood that gardening for the care and weed elimination, construction works and maintenance, as well as the watering of the lawns for sunbathing, have to be accepted by all our guests.
2. Cleaning:
· The obligatory final cleaning, done by the administration, will be payed on site.
· This cleaning will be done as an obligatory intermediate cleaning with a change of linen every 14 days when staying for a longer period of time.
· Additional change of linen and house cleaning is possible any time; this service feature will be arranged and cleared directly with the administration on site.
3. Miscellaneous:
· There are parking spaces next to the houses.
· A cot can be ordered in advance. It will be provided for free.
· Undue high electricity or water consumption (based on the average power consumption) will be charged separately.
4. Special situation on La Palma:
· The private country villas, their furnishings and the surrounding resort are to be treated carefully.
· From unnecessary noise and disturbance of the neighbors’ peacefulness is to be refrained, specially the volume of hi- fi Stereos and the TV have to be kept at tolerable levels.
· Across the estate leads an historical cross cut path; that’s why it´s allowed for hikers and walkers, which hardly ever come by, to pass through.
· Water is scarce on the island, so unnecessary use of water is to be avoided.
· Rubbish is not to be burnt; there are garbage containers along the road. Wet garbage from the kitchen has to be brought outside immediately; otherwise ants and other bugs in the southern climate will enter the house (compost bin).
· Generally is to be said, that on the subtropical island has to be expected the combat against, for example, insects and caterpillars. These necessary measures as well as the work for the maintenance and care of the houses and the garden are to be accepted by our guests.
· It´s to be observed that the cactuses on the property should not be touched, because their tiny pricks cause a lot of pain on the skin. It is allowed to barbecue at the house and in the garden area, fire is not to be left unattended and has to be extinguished subsequently.
5. Utilization:
· The user has the right to use the, in the surrender of use agreed to, country villa (up to two people just one bedroom and one bathroom, unless the use of 2 bedrooms and bathrooms has been agreed clearly) including the furnishings and the utensils.
· He commits himself to treat the country villa and its furnishings very carefully.
· Directions from the administration on site and instruction manuals are to be observed. Technical problems are to be informed to the administration immediately. A repair by oneself cannot be granted.
· As well, the user is committed to replace damage caused by himself or by a companion or guest during the time of use.
· The house rules are part of the user agreement.
· The administration will inform the users about the removal of waste and the possibilities of waste separation.
· On the day of arrival the keys for the respective country villa will generally be handed over from 15.00 onwards. Different agreements with the administration are possible.
· On the day of departure, the property has to be vacated until 10.00.
· All costs on site have to be balanced before the vacating of the property.
· To pay the possible damage on dishes and furniture, the care taker on site, who looks after the house, will arise a caution of 100.00 Euro. The caution will be returned at the end of the time of use, if the house has been handed over orderly and there is no damage to be observed.
· The users should not provide a replacement themselves. With the return of the caution, possible claim of damages from the owner is not touched.
· On the property are fallow areas with, amongst others, cactuses; these areas should be walked on very carefully and with adequate shoes. You enter caves on your own risk. A liability for damages is impossible.
6. Rescission insurances:
There are no insurances included in the charges of use. The closure of a trip cancellation and interruption travel insurance is highly recommended. The user can withdraw anytime from the surrender agreement before the beginning of utilization.
· If the cancellation reaches the owner until 100 days before the beginning of utilization, 20€ lump sum would fall due.
· At a rescission until 51 days before the beginning of utilization, 20% of the cost sharing, at least 30€ in any case, would fall due.
· At a rescission from the 50th to the 35th day before the beginning of utilization, 40% of the agreed cost sharing would fall due.
· At a rescission from the 34th to the 2nd day before the beginning of utilization, 50% of the agreed cost sharing would fall due.
· At a later rescission and in default of appearance, 60% of the cost sharing would be charged.
If a substitute user is named on time, 35€ lump sum will fall due. With the confirmation of the owner, the new attendant will enter in all the rights and liabilities of the surrender contract. On experience, we suggest the closure of a trip cancellation and interruption travel insurance for the pro-rata costs, as you would usually book the house in advance. As a result the risk of illness and accidents is barred. Most travel agencies can help you with the procurement of a trip cancellation and interruption travel insurance. 7. House security:
The open cut construction of the houses requires that, when leaving the property, doors and windows have to be locked diligently. The user has to lock all the doors and windows if there is nobody in or around the house that during the time of utilization has the users’ rights. Parasols have to be shut after using them.
8. Reception and handover of keys:
If desired the user can arrange a meeting point on the Island for the arrival day with the administration on site. The user will be accompanied to the property for the handing over of the respective country villa. The handover of the keys usually results in the afternoon, from 3 pm onwards. Other written agreements are possible. After the handover of keys and the instructions, the use and the responsibility for the house go on to the user for the time of utilization. The passing on of the keys to unauthorized people is not permitted.
9. Legal position:
The legal position of both parties is arranged according to the statutory provisions in Germany, especially according to the Paragraphs 651a-k of the BGB and according to the above mentioned conditions, which complete and complement the valid regulations. Every user recognizes these conditions as binding for himself and for the people registered with him and the temporary guests of the respective country villa. All extra agreements will be done in written form and signed by the owner and the user.
